1. About Servistar
ABN 76 139 821 335, trading as Servistar (“Servistar”, “we”, “us” or “our”), operates the Servistar platform.
Servistar is an online automotive platform that connects customers with independent workshops, mechanics and other automotive service providers (“Service Providers”).
Servistar provides technology that allows customers to search for Service Providers, request and compare quotes, make bookings, communicate with Service Providers, and access other vehicle-related features available through the Servistar website and application.
Servistar does not itself perform vehicle servicing, repairs, inspections or other automotive work. Automotive services are provided by independent Service Providers.
By accessing or using the Servistar platform, creating an account, requesting a quote, or making a booking, you agree to these Terms.
2. Definitions
“Customer”, “you” or “your” means a person who accesses or uses Servistar as a vehicle owner, driver, booking customer or other consumer of automotive services.
“Platform” means the Servistar website, mobile application and related digital services.
“Service Provider” means an independent workshop, mechanic, mobile mechanic, automotive business or other provider offering services through Servistar.
“Automotive Services” means servicing, repairs, inspections, diagnostics, maintenance, mobile mechanic services and other vehicle-related services offered by a Service Provider.
“Booking” means a request or confirmed arrangement for Automotive Services made through the Platform.
“Quote” means pricing or an estimate provided by a Service Provider for requested Automotive Services.
3. Eligibility and Customer Responsibilities
You must be at least 18 years old and legally capable of entering into an agreement to make a Booking through Servistar.
When using the Platform, you must provide information that is accurate, current and complete.
This includes, where relevant:
- your contact details;
- vehicle registration;
- vehicle make, model and year;
- odometer reading;
- service history;
- information about vehicle faults, warning lights or symptoms; and
- any other information reasonably required to provide a Quote or perform the requested Automotive Services.
Quotes, recommendations and Bookings may be affected if the information you provide is inaccurate or incomplete.
You are responsible for updating information where you become aware that it is incorrect.
4. Quotes and Pricing
Service Providers are responsible for setting their own prices for the Automotive Services they offer through Servistar.
Servistar does not determine the final price charged by a Service Provider unless expressly stated on the Platform.
A Quote may be based on the information you provide before the vehicle has been physically inspected. The final scope or price may therefore change if an inspection identifies different or additional issues, required parts, labour or other circumstances that could not reasonably have been identified from the original information.
Where a price is described as an estimate, it is indicative only.
Where a Service Provider provides a fixed Quote for an agreed scope of work, any proposed change to that Quote or scope should be communicated to you before additional work is performed.
Prices displayed on the Platform will be in Australian dollars unless otherwise stated.
You should review what is included and excluded from a Quote before accepting it.
5. Booking Requests and Confirmation
Submitting a Booking request through Servistar does not necessarily mean that the Booking has been accepted by the Service Provider.
Service Providers remain responsible for deciding whether they have the availability, equipment, capability and resources required to accept a particular job.
A Booking becomes confirmed when the Service Provider accepts the request and confirmation is provided through Servistar or directly by the Service Provider.
Requested dates, times and availability are subject to confirmation.
Service Providers may need to contact you for further information before confirming a Booking or Quote.
Servistar does not guarantee that every Booking request will be accepted or that every Service Provider will be available at the time requested.
6. Agreement with the Service Provider
When a Booking for Automotive Services is confirmed, the agreement for the performance of those Automotive Services is between you and the selected Service Provider.
The Service Provider is responsible for performing the Automotive Services it has agreed to provide.
Servistar facilitates the connection, communication and Booking between you and the Service Provider but does not become the repairer or provider of the Automotive Services.
A Service Provider may also have reasonable terms, policies or conditions that apply to the Automotive Services it provides. These may relate to matters such as vehicle drop-off and collection, workshop safety, road testing, payment arrangements, storage, mobile services, warranties or other operational requirements.
Any Service Provider-specific terms should be made available or communicated to you where they are relevant to your Booking.
Nothing in a Service Provider’s terms or these Terms limits rights that cannot legally be excluded.
7. Additional Work and Customer Authorisation
A Booking or Quote authorises the Service Provider to perform the work that you have agreed to.
If inspection or diagnosis identifies additional work that was not included in the agreed scope, the Service Provider should explain the additional work and any additional cost before proceeding where your approval is required.
You are responsible for deciding whether to authorise additional work.
Servistar does not authorise additional repairs or services on your behalf.
If the Service Provider cannot contact you, it should not assume that you have authorised additional chargeable work unless you previously gave clear instructions permitting that work or applicable law allows otherwise.
Safety concerns identified during an inspection may be communicated to you even if you choose not to proceed with the recommended repair.
8. Payments
Each Service Provider controls the payment methods it accepts unless a particular payment method is made available through the Servistar Platform.
The applicable payment arrangements should be shown or communicated to you during the Booking process, by the Service Provider or before payment becomes due.
Unless Servistar expressly states otherwise, payment for Automotive Services is payable to the Service Provider.
Where Servistar enables or facilitates an online payment, payment may be processed through a third-party payment provider.
Using a third-party payment service may also be subject to that provider’s terms and privacy policy.
Facilitating or processing a payment does not make Servistar the supplier of the Automotive Services.
You are responsible for paying all amounts that you have validly authorised and that become due under your agreement with the Service Provider.
Any additional amount resulting from approved additional work should be clearly communicated to you.
The Service Provider is responsible for providing any invoice or receipt required in relation to the Automotive Services it supplies.
9. Cancellations, Rescheduling and No-Shows
Cancellation and rescheduling conditions may differ between Service Providers.
Where a Service Provider has a specific cancellation, rescheduling or no-show policy, that policy should be disclosed or made available to you before it is applied.
If you need to cancel or reschedule a Booking, you should do so as soon as reasonably possible through the Platform or by contacting the Service Provider.
A Service Provider may charge a cancellation or no-show fee where such a fee was properly disclosed and agreed to, is reasonable in the circumstances and is permitted by law.
If you have made a payment through the Platform and a refund becomes payable, Servistar may assist with processing the refund through the original payment method where technically available.
Refund rights are also subject to any rights you have under the Australian Consumer Law.
Servistar may assist with Booking changes and cancellations but does not guarantee that a Service Provider will be able to accommodate a requested change.
10. Automotive Services and Service Provider Responsibilities
Service Providers operating through Servistar are independent businesses.
Each Service Provider is responsible for:
- the Automotive Services it agrees to perform;
- its employees, contractors and mechanics;
- diagnosis and professional recommendations;
- the quality and safety of its work;
- parts and materials it supplies;
- compliance with applicable licensing, repairer and consumer laws;
- workplace and workshop safety;
- invoices and receipts for its services;
- any voluntary warranties it provides; and
- resolving issues relating to the Automotive Services it has performed.
Servistar does not control the day-to-day manner in which an independent Service Provider performs automotive work.
Information displayed about a Service Provider, including profile information, ratings, reviews, experience, services or verification indicators, is intended to help customers make informed decisions.
Where Servistar describes a Service Provider as verified or displays a verification indicator, the verification relates only to the checks or information associated with that feature and should not be interpreted as a guarantee that a particular Service Provider or Automotive Service will meet every customer’s individual requirements.
11. Parts, Warranties and Replaced Components
The Service Provider is responsible for determining and communicating what parts, fluids and materials are proposed for your vehicle.
You should review the relevant Quote or ask the Service Provider if you require information about whether parts are genuine, original equipment, aftermarket, reconditioned or otherwise.
Servistar does not provide a universal warranty covering parts or workmanship supplied by independent Service Providers.
Any express warranty offered for parts or labour is provided by the relevant Service Provider or manufacturer according to the warranty conditions communicated to you.
Such warranties are in addition to any rights you may have under the Australian Consumer Law.
If you wish to inspect or retain replaced parts, you should discuss this with the Service Provider before work begins, as some parts may be subject to exchange, warranty, recycling or other requirements.
12. Workshop-Specific Vehicle Policies
Because Servistar does not physically service or hold your vehicle, individual Service Providers may have their own policies concerning matters such as:
- road testing;
- vehicle storage;
- uncollected vehicles;
- keys and security;
- valuables left inside vehicles;
- child seats;
- dash cameras;
- courtesy vehicles;
- after-hours collection; and
- workshop access and safety.
You should follow any reasonable policy communicated by the Service Provider in connection with your Booking.
Servistar does not impose a universal child-seat removal policy, dash-camera policy, storage charge or road-testing policy on all Service Providers.
Any fee or condition imposed by a Service Provider should be disclosed or agreed where required by law.
13. Mobile Automotive Services
Some Service Providers may offer mobile Automotive Services at a customer’s home, workplace or another agreed location.
Where you book a mobile service, you are responsible for providing an accurate location and ensuring that the Service Provider has reasonable and lawful access to the vehicle.
You should ensure, where applicable, that:
- the vehicle is located in a reasonably safe and accessible area;
- you have permission for work to be performed at the location;
- there is sufficient space for the Service Provider to work safely; and
- any relevant parking, access or property restrictions have been communicated.
A mobile Service Provider may decline, postpone or relocate work where the location is unsafe, inaccessible, unsuitable or prohibited.
Additional call-out, travel or location-related charges may apply only where they have been disclosed or agreed.
14. Vehicle Information, Service Records and Reminders
Servistar may allow you to store or manage vehicle information, service history, registration information, documents, images, maintenance records and reminders.
These features are provided to help you organise vehicle-related information.
You are responsible for checking important vehicle information and keeping your records up to date.
Service reminders, registration reminders, maintenance intervals and similar notifications provided through Servistar are convenience features and should not be treated as a substitute for:
- the vehicle manufacturer’s requirements;
- the vehicle’s logbook;
- official registration information;
- safety inspections;
- professional mechanical advice; or
- legal requirements applying to your vehicle.
You should seek advice from an appropriately qualified Service Provider where you are uncertain about the condition, servicing or safety of your vehicle.
15. Automated and AI-Assisted Features
Servistar may use automated systems or artificial intelligence to support features such as:
- matching customers with Service Providers;
- service suggestions;
- maintenance reminders;
- scheduling assistance;
- vehicle-related recommendations; and
- other Platform functionality.
Automated or AI-generated information may be based on the information available to the Platform and may not always be complete, current or accurate.
Such information is intended to assist users and does not constitute a mechanical inspection, diagnosis or professional automotive advice.
You should independently confirm important information with the vehicle manufacturer, relevant authority or a suitably qualified Service Provider before making decisions concerning vehicle safety, servicing or repairs.
16. Accounts and Account Security
Some Servistar features may require you to create an account.
You are responsible for keeping your login credentials secure and for activity conducted through your account where that activity results from your failure to take reasonable steps to protect those credentials.
You must notify Servistar as soon as reasonably possible if you believe that your account has been accessed without authorisation.
You must not create an account using false information, impersonate another person or use another person’s account without permission.
Servistar may require reasonable verification of your identity or account information where necessary for security, fraud prevention or Platform operation.
17. Reviews and Ratings
Servistar may allow customers to submit ratings, reviews or feedback about Service Providers or their experience using the Platform.
Reviews should reflect genuine experiences and must not contain content that is:
- knowingly false or misleading;
- defamatory or unlawfully threatening;
- discriminatory or abusive;
- fraudulent;
- unrelated to the relevant experience;
- promotional or spam;
- in violation of another person’s privacy; or
- otherwise unlawful.
Servistar may moderate, temporarily hide or remove content where reasonably necessary to enforce these Terms, comply with law, investigate misuse or maintain the integrity of the review system.
Submitting a review does not transfer ownership of your content to Servistar.
However, you grant Servistar a non-exclusive, royalty-free licence to host, reproduce, display and distribute the content as reasonably necessary to operate, promote and improve Servistar and its review features.
18. User Content and Uploaded Documents
You may be able to upload photographs, documents, vehicle records, messages or other information to the Platform.
You remain responsible for content you upload.
You must have the right to provide the content and must not upload material that:
- infringes another person’s intellectual property rights;
- contains unlawful material;
- contains malicious code;
- violates another person’s privacy without proper authority; or
- is misleading, fraudulent or intentionally harmful.
You grant Servistar a non-exclusive licence to store, process, reproduce and transmit your uploaded content to the extent reasonably necessary to provide Platform features and services to you.
You should retain your own copies of important vehicle, financial or legal documents. Servistar should not be used as the sole permanent storage location for important records.
19. Acceptable Use of Platform
You must not use Servistar to:
- engage in unlawful, fraudulent or deceptive conduct;
- interfere with the security or operation of the Platform;
- introduce malware, viruses or harmful code;
- attempt to gain unauthorised access to accounts, systems or data;
- scrape or systematically extract Platform information without permission;
- impersonate another person or business;
- harass Service Providers, customers or Servistar personnel;
- manipulate reviews or ratings;
- make fraudulent Booking requests;
- use another person’s payment details without authority; or
- use the Platform in a way that materially interferes with other users.
Servistar may take reasonable steps to investigate suspected misuse and protect users, Service Providers and the Platform.
20. Privacy and Communications
Servistar handles personal information in accordance with its Privacy Policy, as updated from time to time in accordance with applicable law.
By using the Platform, you acknowledge that information relevant to a Booking may need to be shared between Servistar and the Service Provider involved in that Booking.
Servistar may send service-related communications including:
- Booking confirmations;
- Quote notifications;
- Booking changes;
- messages from Service Providers;
- service and registration reminders;
- account and security notices; and
- information reasonably necessary to operate the Platform.
These operational communications may be necessary for the service you have requested.
Marketing communications will be handled separately and may be opted out of as permitted by law.
21. Third-Party Services
Servistar may use or integrate services provided by third parties, including payment processors, mapping services, analytics providers, communication services and other technology providers.
Some Platform features may therefore be subject to third-party terms or privacy policies.
Servistar is not responsible for the independent operation of third-party websites or services that it does not control.
Links to third-party websites are provided for convenience and do not necessarily constitute endorsement of all information, products or services available from those websites.
22. Intellectual Property
The Servistar Platform and its underlying software, branding, design, text, graphics, databases and other content created or owned by Servistar are protected by applicable intellectual property laws.
Except as permitted by law or expressly authorised by Servistar, you must not reproduce, modify, distribute, commercially exploit, reverse engineer or create derivative works from Servistar’s proprietary Platform content or technology.
This section does not give Servistar ownership of content that you or a Service Provider independently owns.
23. Platform Availability
Servistar aims to provide a reliable Platform but cannot guarantee that the website, application or every feature will always be available without interruption or error.
The Platform may occasionally be unavailable because of maintenance, upgrades, technical issues, third-party service failures or events outside Servistar’s reasonable control.
Servistar may modify, improve, replace or discontinue Platform features from time to time.
Where a material change affects an existing confirmed Booking, Servistar will take reasonable steps to avoid unnecessary disruption or provide relevant information where practicable.
24. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or other protection that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
Depending on the circumstances, services supplied to consumers may be required to:
- be provided with due care and skill;
- be fit for an agreed purpose; and
- be supplied within a reasonable time where no time has been agreed.
The Service Provider is responsible for meeting consumer guarantees applying to the Automotive Services and goods that it supplies.
Servistar remains responsible for consumer guarantees or other legal obligations that apply to the services that Servistar itself supplies.
Any express warranty provided by a Service Provider or manufacturer is in addition to rights that may apply under the Australian Consumer Law.
25. Liability
Servistar is responsible for the Platform services that it supplies, subject to these Terms and applicable law.
Independent Service Providers are responsible for the Automotive Services that they perform and for goods, parts, advice and warranties that they supply.
To the extent permitted by law, Servistar is not responsible for loss or damage arising solely from the acts, omissions, workmanship, diagnosis, advice or Automotive Services of an independent Service Provider.
Servistar is also not responsible for information supplied by a Customer or Service Provider where Servistar has reasonably relied on that information in operating the Platform.
Nothing in these Terms limits or excludes liability where doing so would be unlawful, including liability arising under consumer guarantees that cannot be excluded.
Where liability can lawfully be limited, any limitation will apply only to the extent permitted by applicable law.
26. Complaints and Dispute Resolution
If your concern relates to automotive work, parts, diagnosis, workmanship, pricing or another matter concerning Automotive Services performed by a Service Provider, you should first raise the issue directly with that Service Provider.
Servistar may, where appropriate, assist communication between you and the Service Provider but does not replace either party in resolving their contractual obligations.
If your concern relates to the Servistar Platform, your account, a Platform feature or a payment processed through Servistar, you may contact Servistar Support.
We aim to review complaints fairly and within a reasonable time.
Nothing in this section prevents you from exercising any right to contact a consumer protection authority, regulator, tribunal or court.
27. Suspension or Termination of Access
Servistar may suspend or restrict access to an account where reasonably necessary to:
- investigate suspected fraud or unauthorised activity;
- protect the security of the Platform;
- prevent harm to other users or Service Providers;
- respond to a serious or repeated breach of these Terms; or
- comply with a legal or regulatory obligation.
Where reasonably practicable, Servistar will provide notice or an explanation of a suspension or restriction.
You may stop using Servistar at any time and may request closure of your account subject to any information Servistar is required or reasonably permitted to retain for legal, security, dispute or record-keeping purposes.
Termination of a Servistar account does not automatically cancel obligations already arising from an existing Booking or agreement with a Service Provider.
28. Changes to These Terms
Servistar may update these Terms where reasonably necessary to reflect changes to:
- the Platform or its features;
- business operations;
- legal or regulatory requirements;
- security requirements; or
- the way Servistar provides its services.
The latest version will be published on the Servistar website.
Where a change is material and reasonably affects existing users, Servistar will take reasonable steps to provide notice where practicable.
Changes will generally apply from the date the updated Terms are published, unless a later effective date is stated.
Unless required by law or agreed with you, changes to these Terms will not retrospectively alter the essential terms of an already confirmed Booking.
If you continue using the Platform after updated Terms take effect, your continued use will be subject to the updated Terms.
29. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.
Where mandatory consumer, automotive repair or other legislation of another Australian state or territory applies to a particular transaction, these Terms do not exclude the operation of that legislation.
Subject to any rights you have to commence proceedings elsewhere under applicable law, the parties submit to the courts and tribunals having jurisdiction in New South Wales.
30. General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to operate to the extent permitted by law.
A failure by Servistar to enforce a provision on one occasion does not mean that Servistar permanently waives that provision.
Headings are included for convenience and do not affect the interpretation of these Terms.
References to legislation include amendments, replacements and regulations made under that legislation.
These Terms should be read together with the Servistar Privacy Policy and any additional terms expressly presented to you in connection with a particular Platform feature or transaction.
If there is an inconsistency between these Terms and mandatory law, the mandatory law prevails.
